TIDAL Content Guidelines

These content guidelines ("Content Guidelines") apply when using any of TIDAL’s websites, platforms, applications or services (“TIDAL Services”), including when you upload and/or share your own content to or from the TIDAL Services ("Content"). These Content Guidelines are designed so everyone can enjoy using the TIDAL Service safely and comfortably. These Content Guidelines may be updated periodically. Violation of these Content Guidelines may result in the removal of content or material you have uploaded to the TIDAL Service and/or termination or suspension of your account.

You must not upload or share any Content which, in TIDAL’s reasonable opinion:

  • Constitutes or promotes an illegal act of any kind, including but not limited to violations of intellectual property, privacy or proprietary rights of TIDAL or a third party;
  • Constitutes or promotes any act that would violate any agreement to which you are a party, including but not limited to recording or publishing agreements;
  • Solicits or discloses personal, confidential or proprietary information of third parties;
  • Constitutes or advocates for harassment, bullying, threatening, or self harm;
  • Contains or links to explicit content such as nudity, excessive violence, or hateful content;
  • Constitutes or promotes information that you know is false or misleading or promotes activities or conduct or contains content that is abusive, threatening, obscene, defamatory or libelous;
  • Involves any form of user tracking, commercial activities and/or sales without prior written consent from TIDAL;
  • Includes malicious content such as malware, Trojan horses, or viruses, or otherwise interferes with any user's access to the TIDAL Service;
  • Impersonates or misrepresents your affiliation with TIDAL (including, but not limited to, using any of TIDAL’s intellectual property without permission), another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading;
  • Interferes with or in any way disrupts, or attempts to interfere with or disrupt, the TIDAL Services; or
  • Conflicts with any other terms or policies applicable to your use of any of the TIDAL Services.

You further agree not to undertake any of the following activities on the TIDAL Services:

  • Circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the TIDAL Services;
  • Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of any material on the TIDAL Services, except where such restriction is expressly prohibited by applicable law;
  • Copying, reproducing, redistributing, "ripping," recording, performing, or otherwise using content or material on the TIDAL Services which is not expressly permitted under the Agreements or applicable law, or which infringes intellectual property rights;
  • Criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files;
  • Uploading, importing or copying any material or content that you do not have the legal right to upload, import or copy in this way;
  • "Crawling", "scraping", or data mining — whether manually or by automated means, or otherwise using any automated means (including bots, scrapers, and spiders), to view, access or collect information;
  • Using any part of the TIDAL Services or Content to train a machine learning or artificial intelligence model or otherwise supplying Content to a machine learning or artificial intelligence model;
  • Artificially increasing play counts, artificially promoting content or material made available through the TIDAL Services, or otherwise manipulating the content or material made available through the TIDAL Services including by (i) using any bot, script or other automated process, (ii) providing or accepting any form of compensation (financial or otherwise), or (iii) any other means;
  • Removing or altering any copyright, trademark, or other intellectual property notices on the TIDAL Services;
  • Advertising to, or solicitation of, any user of the TIDAL Services;
  • Covering or obscuring advertisements that appear on the TIDAL Services;
  • Impersonating or attempting to impersonate or hold yourself out as another user, person or entity;
  • Selling or otherwise transferring your account; or
  • Using the TIDAL Services in a manner inconsistent with any other terms or policies applicable to your use of the TIDAL Services, or in a manner inconsistent with any applicable laws and regulations.

TIDAL Content Moderation Guidelines

TIDAL is committed to maintaining a safe and respectful platform for all users. To achieve this, we employ a combination of automated tools and human review processes to monitor and manage Content that is uploaded to the platform (“Content Moderation”). The goal is to ensure compliance with our Content Guidelines while providing a fair and transparent experience for all users.

Automated Content Moderation: TIDAL utilizes automated systems to assist in Content Moderation. This proactive approach allows TIDAL to identify and address harmful Content before it is reported by users. These automated tools, including artificial intelligence technologies, scan and filter Content upon upload to identify and flag potential violations.

Human Review in Content Moderation

While automated tools provide initial detection, human review plays a critical role in the Content Moderation process, including:

  • Review of Flagged Content: Our moderation teams review Content flagged by automated systems when necessary for accuracy, assessing whether the Content violates the Content Guidelines. Moderation teams also review Content reported by you for potential violations.
  • Handling Appeals: You can appeal decisions made by automated tools or human review, prompting a thorough review by a human moderator. This ensures fairness and transparency in the decision-making process. See “Appeals and User Rights” below for more information.
  • Critical Decisions: For serious actions such as account suspension or termination, a human review is conducted before finalizing the decision.

Content Moderation Process

The Content Moderation process may include the following steps depending on the product:

  • Initial Detection: Automated tools scan and flag Content that may potentially violate our Content Guidelines upon upload.
  • Human Review: Our moderation teams review flagged Content when necessary to determine appropriate actions, ensuring accurate enforcement of our Content Guidelines.
  • Content Removal or Warning: Content found to be in violation may be removed, and you may receive warnings or restrictions based on the severity of the violation.
  • User Appeals: You can appeal Content removal or account-related decisions. Human reviewers reassess the Content and the initial decision. See “Appeals and User Rights” below for more information.
  • Final Decision: After the appeal, the decision may be upheld, reversed, or modified, with you notified of the outcome.

Appeals and User Rights

TIDAL is committed to providing you with a fair Content Moderation process. If you disagree with a decision, you have the right to appeal by sending it to support@tidal.com or replying to the removal notice. Appeals are reviewed by human moderators, ensuring a balanced approach between automated detection and human judgment. TIDAL informs you of the outcome of your appeals and any subsequent actions taken.
